1.1 Account Information

Depending on how you use TendeAI, we may collect:

1.2 Health and Fitness Information

TendeAI allows you to voluntarily enter health and fitness information for the purpose of tracking your personal health and fitness goals.

This may include:

• Age;
• Weight;
• Height;
• Sex or biological profile information where required for calculations;
• Daily calorie targets;
• Food and caloric intake;
• Meals and food records;
• Exercise and activity records;
• Exercise duration or estimated energy expenditure;
• Weight-management goals;
• Progress toward goals;
• Other information you voluntarily enter into the application for health and fitness tracking.

This information may constitute sensitive or health-related personal information under applicable laws.

1.3 Information You Provide About Food and Exercise

When you use TendeAI to record meals, foods, calories, workouts, or physical activity, we process the information you provide so that the application can calculate, display, store, and track your progress.

1.4 Device and Technical Information

We may automatically receive certain technical information when you use TendeAI, such as:

• Device type;
• Operating-system version;
• Application version;
• Device identifiers where technically necessary;
• Crash information;
• Diagnostic information;
• General performance information;
• Approximate usage information.

We do not use technical information to sell your personal information.

2. How We Use Your Information

We use information collected through TendeAI only for legitimate purposes connected with operating and improving the Service.

These purposes include:

• Creating and maintaining your account;
• Calculating calorie and fitness targets;
• Recording meals and exercise;
• Tracking your progress;
• Providing personalized fitness and nutrition-related features;
• Displaying statistics and progress information;
• Providing reminders and notifications you enable;
• Providing customer support;
• Maintaining application security;
• Detecting fraud, abuse, or unauthorized activity;
• Diagnosing technical problems;
• Improving application performance and usability;
• Developing and improving TendeAI;
• Processing subscriptions and verifying purchases;
• Complying with applicable legal obligations.

2.1 Health and Fitness Data Is Not Sold

We do not sell your health, fitness, food, exercise, or calorie-tracking information.

We do not sell personal health information to advertisers, data brokers, insurance companies, or other third parties.

We use your health and fitness information to provide the TendeAI functionality you request and to maintain and improve the Service in accordance with this Privacy Policy and applicable law.

3. Analytics and Vexo Analytics

TendeAI uses Vexo Analytics to understand how users interact with the application and to identify technical and usability problems.

Vexo may process information relating to:

• App sessions;
• Feature usage;
• Screen or page interactions;
• Session duration;
• Application performance;
• Crash and diagnostic information;
• General engagement information;
• Technical information associated with application usage.

TendeAI configures analytics to use anonymous or appropriately de-identified usage information for product analytics where technically possible.

Vexo analytics information is used to help us understand how TendeAI is being used, identify problems, measure application performance, and improve the user experience.

Vexo is not authorized by TendeAI to use your health and fitness records for advertising or to sell them.

4. Payment Processing

TendeAI does not directly store or process your full credit-card number or other complete payment-card credentials.

If you purchase a subscription through the Apple App Store, Apple processes the transaction through Apple’s In-App Purchase system.

If you purchase a subscription through Google Play, Google processes the transaction through Google Play Billing.

Depending on the platform, we may receive limited transaction information necessary to verify your purchase and provide your subscription, such as:

• Purchase identifier;
• Subscription status;
• Product or subscription identifier;
• Purchase or renewal information;
• Expiration information.

We do not receive or store your complete payment-card number through these systems.

Apple and Google maintain their own privacy and payment policies, which govern information processed directly by their payment systems.

5. How We Share Information

We do not sell your personal information.

We may disclose information only when reasonably necessary for the following purposes:

Service Providers

We may use trusted third-party service providers that process information on our behalf, such as providers supporting:

• Cloud infrastructure;
• Database hosting;
• Authentication;
• Analytics;
• Crash reporting;
• Application infrastructure;
• Customer support;
• Subscription verification.

These providers may access information only to the extent necessary to provide services to TendeAI and are expected to maintain appropriate safeguards.

Legal Requirements

• Comply with a court order or government request;
• Protect the rights, property, or safety of TendeAI, our users, or others;
• Detect or investigate fraud, abuse, security incidents, or unlawful activity.

If TendeAI or substantially all of its assets are involved in a merger, acquisition, financing, restructuring, or sale, information may be transferred as part of that transaction, subject to applicable legal requirements.

6. Health Data Restrictions

Because TendeAI handles health and fitness-related information, we treat such information with additional care.

We do not use health or fitness information for:

• Selling data;
• Data-broker activities;
• Targeted advertising based on health information;
• Insurance underwriting;
• Employment decisions;
• Unrelated commercial profiling.

We only process health and fitness information for purposes connected to providing, securing, supporting, or improving TendeAI, or where otherwise permitted or required by law.

7. Data Retention

We retain personal information only for as long as reasonably necessary to:

• Provide the Service;
• Maintain your account;
• Provide requested functionality;
• Meet legal obligations;
• Resolve disputes;
• Prevent fraud and abuse;
• Enforce our agreements;
• Maintain legitimate business records.

When information is no longer reasonably necessary, we will delete it, anonymize it, or otherwise dispose of it in accordance with applicable law and our technical capabilities.

Certain information may remain in backups for a limited period before being permanently overwritten.

8. Account and Data Deletion

You may request deletion of your TendeAI account and associated personal information.

Where TendeAI provides an in-app account deletion function, you may use that function to initiate deletion.

You may also contact us using the contact information provided at the end of this Privacy Policy.

When a deletion request is received, we will take reasonable steps to delete or anonymize information that we are not legally required or otherwise permitted to retain.

Some information may be retained when necessary to comply with legal obligations, prevent fraud, resolve disputes, enforce agreements, or protect our rights.

Deleting your account does not necessarily cancel an Apple or Google subscription. Subscriptions must be cancelled through the applicable app-store account.

9. Your Privacy Rights

Depending on where you live and the laws applicable to you, you may have rights including:

• The right to know whether we process your personal information;
• The right to request access to personal information;
• The right to correct inaccurate information;
• The right to request deletion;
• The right to request restriction of processing;
• The right to object to certain processing;

Rights vary depending on your jurisdiction and applicable law.

For users subject to Uganda’s data-protection framework, TendeAI will handle applicable requests in accordance with the Data Protection and Privacy Act, 2019 and applicable regulations.

10. International Data Transfers

TendeAI may use service providers whose systems are located outside your country.

As a result, personal information may be processed or stored in countries other than the country where you live.

Where required by applicable law, we will implement appropriate safeguards for international transfers.

11. Data Security

We use reasonable technical and organizational safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction.

However, no Internet transmission or electronic storage system can be guaranteed to be completely secure.

You are responsible for protecting your account credentials and should notify us if you believe your account has been compromised.

12. Children’s Privacy

TendeAI is intended for users 18 years of age or older.

TendeAI does not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without legally required parental consent, we will take reasonable steps to delete that information.

If you believe a child has provided personal information to TendeAI, please contact us.

13. Third-Party Services

TendeAI may rely on third-party services necessary to operate the application.

Such providers may include:

• Apple;
• Google;
• Vexo Analytics;
• Cloud infrastructure providers;
• Authentication providers;
• Database and storage providers;
• Other infrastructure or service providers used by TendeAI.

Third-party services operate under their own terms and privacy policies.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

When we make material changes, we may provide notice through the application, website, or other appropriate means.

The updated Privacy Policy will include a new “Last Updated” date.

Your continued use of TendeAI after an updated Privacy Policy becomes effective means that you acknowledge the updated policy, to the extent permitted by law.
